Prayer : Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus calling for the records pertaining to the proceedings of the 2nd respondent in Na.Ka.No.100748/H5/2021 dated 30.06.2021 and to quash the same as illegal, incompetent and ultravires and consequently direct the respondents to change the petitioner name to R.Sam Isaac instead of R.Murugan in the School Mark Sheets.

This writ petition has been filed challenging the impugned proceedings of the second respondent dated 30.06.2021 wherein the request made by the petitioner to change the name in the school records from 'R.Murugan' to 'R.Sam Isaac' was rejected.

2. Heard Ms.R.Shase, learned counsel appearing for the petitioner and Mr.A.Selvendran, learned Government Advocate appearing for the respondents.

3. It is seen from records that the name of the petitioner was 'R.Murugan' when he underwent 10th Standard and 12th Standard. Therefore, the school records and the relevant certificates reflect the name of the petitioner as 'R.Murugan'. The petitioner has chosen to change his name as 'R.Sam Isaac' only in the year 2006 and thereafter the name change was effected by publishing the same in the Tamilnadu Official Gazette on 13.07.2016. The gazette reflects the name of the petitioner as 'R.Sam Isaac'.

4. In view of the above development, the petitioner made a representation to the respondents to effect the change in name in all the school certificates. The said request made by the petitioner came to be rejected by the second respondent through the impugned proceedings dated 30.06.2021. Aggrieved by the same, the present writ petition has been filed before this Court.

5. In the considered opinion of this Court, this Court does not find any illegality or infirmity in the decision taken by the second respondent. The second respondent was absolutely right in saying that the petitioner was called as 'R.Murugan' at the time when the 10th and 12th Standard certificates were issued to him and the subsequent change in name that took place after nearly 20 years, cannot be a ground for effecting change in name in the school certificates. The change in name will come into effect only from the date it is published in the gazette. Thereafter, the petitioner will be identified by the new name and that does not mean that the petitioner will be allowed to change the name in all the certificates that were given earlier to the name change being effected.
