ORDER
The present wit petition has been filed with a prayer for Mandamus to direct the 3rd respondent to take departmental action as per rules against the 5th respondent on the petitioner's representation dated 31.07.2024 and consequently direct the respondent police to investigate the petitioner's complaint dated 20.11.2023.

The learned counsel appearing on behalf of the petitioner would submit that when the petitioner went to Negamam police station on 25.10.2023 to give a complaint about missing of jewels, the then Inspector of Police, the 5th respondent viz., R.Dharmaraj did not receive the complaint and diverted the petitioner to approach the local panchayat and thereby, the then Inspector of police has not discharged his duty as expected from a Government servant. In this connection, the petitioner has sent a representation to the Chief Secretary on 31.07.2024 to take disciplinary action 2/5
against the said Dharmaraj, the then Inspector of Police. The petitioner has also sent the copy of the same to the Collector and the Sub-Collector. The Sub Collector has also forwarded the complaint to the Superintendent of Police vide letter dated 16.08.2024 and such complaint is yet to be considered by the Superintendent of Police.
3. At this juncture, the learned Government Advocate appearing on behalf of the respondents would fairly submit that they would consider the petitioner's representation dated 31.07.2024 within a reasonable time.
4. I have given my anxious consideration on either side submission.
5. In such view of the matter without going to the merits of the writ petition, this Court deems it appropriate to direct the 2nd respondent to consider the petitioner's representation dated 31.07.2024 and pass order according to its own merits and in accordance with law, after giving prior notice to the 5th respondent / Mr.R.Dharmaraj, within a period of twelve (12) weeks from the date of receipt of a copy of this order. 3/5
6. With the above observations, the writ petition stands disposed of. No costs.
