This miscellaneous petition has been filed seeking to direct the first respondent/ Management to pay last drawn wages to the petitioner under Section 17 - B of the I.D. Act from the date of Award, i.e., 01.04.2013 to till the date of disposal of the above writ petition. 2.The first respondent Management has filed the writ petition as against the order of the second respondent dated 05.10.2012 in I.D.No.67 of 2009 directing the first respondent to reinstate the petitioner in service with 25% of the backwages, continuity of service and all other attendant benefits.

3.The learned counsel for the petitioner submitted that the first respondent/ Management ought to have paid the last drawn wages to the petitioner under Section 17 - B of the I.D. Act from the date of Award, i.e., 01.04.2013, however, till date the Management has not paid the same and further submitted that the petitioner has retired 1/3

from service on 31.05.2022 and hence the petitioner is entitled for the same till the date of retirement from service, i.e., 31.05.2022. 4.Heard both sides.

5.This Court finds some force in the submission made by the learned counsel for the petitioner. Hence, the first respondent/ Management is directed to pay the last drawn wages to the petitioner under Section 17 - B of the I.D. Act from the date of Award, i.e., 01.04.2013, till the date of retirement from service, i.e., 31.05.2022, within a period of eight weeks from the date of receipt of a copy of this order.

6.This miscellaneous petition is accordingly ordered. 7.List the writ petition for hearing after the first respondent/ Management files proof of payment as directed above. 13.02.2023 pri 2/3
