ORDER

The petitioner is the wife who has been arrayed as the respondent in the HMOP proceedings initiated by the respondent/husband in HMOP.No.1619 of 2024 before the Family Court, Madurai.

2. Despite service of notice on the respondent/husband in this transfer petition, the respondent has neither chosen to appear in person nor through counsel. Hence, the respondent is called and set exparte.

3. I have heard the learned counsel for the petitioner/wife and I have also gone through the affidavit filed in support of this transfer petition.

4. Learned counsel for the petitioner would take me through the averments set out in the affidavit filed in support of this transfer petition and submits that the petitioner being a resident of Porur has sought for transfer of the HMOP proceedings from the file of the Family Court, Madurai to the file of the Sub Court, Alandur. The learned counsel also Page No.2 of 4

contends that the petitioner/wife has to take care of her minor child aged about 9 years and it would be very much inconvenient for her to travel all the way to Madurai to attend the HMOP proceedings.

5. I am satisfied that the petitioner has made out a good ground for seeking transfer and accordingly, this Transfer Civil Miscellaneous petition stands allowed and the case in HMOP.No.1619 of 2024 is withdrawn from the file of the Family Court, Madurai and the same is transferred to the file of the Sub Court, Alandur.
