PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of a writ of certiorarified mandamus directing the respondents to regularize the service of the petitioner and make her permanent in the post of Junior Assistant cum Typist from retrospective effect from 2002 in the 2nd respondent Salem District Anti T.B. ORDER
This writ petition has been filed to direct the respondents to regularize the service of the petitioner and make her permanent in the post of Junior Assistant cum Typist from retrospective effect from 2002 in the 2nd respondent Association.
2. According to the submission of the learned counsel for the petitioner the second respondent association has sanctioned the full time post of Junior Assistant cum Typist for the District Anti.TB Association. As against the said
post the petitioner has been appointed as Junior Assistant cum Typist on 25.11.2002 but however on consolidated pay of Rs.2000/- per month. The petitioner has been sending request to regularize the services but no order has been passed so far.
3. Mr.Tippu Sulthan, the learned Government Advocate for the respondents, submitted that the second respondent is a Society and it cannot be considered as a limb of the Government in order to claim regularization from the Government.
4. It seems that the second respondent association is funded by the Government and the salaries of its employees have also been borne with the funds given by the Government. The petitioner is seen to have kept under consolidated services from the very beginning when she was appointed in the year 2002. Even though the petitioner has not been appointed through regular recruitment process, the petitioner's services have been extracted for years together without any scheme or order for regularization.
5. In view of the continuous services rendered by the petitioner beyond 15 years, the representation of the petitioner shall be benevolently considered by the first respondent for framing any scheme or issuing any order by absorbing the petitioner as expeditiously as possible.
6. Accordingly the writ petition is disposed with a direction to the first respondent to consider the representation of the petitioner and pass orders by framing any scheme or issuing any order by absorbing the petitioner, within a period of four weeks from the date of receipt of a copy of this order.
