9253 OF 2018] [ii] Exemption from the surrender the petitioner disposal of the Criminal revision petition preferred against the conform the conviction and sentence passed by Additional Session Judge (Fast Track Court) at Kancheepuram CRL.A.No. 1 of 2017 dated 20.04.2018 the conviction, sentence of imprisonment as well as fine made by the judgement dated 22.12.2016 in S.C.No.83 oof 2012 delivered by the learned Assistant Session Judge at Kancheepuram, in CRL RC.816/2018 [IN CRL.MP.NO.9254 OF 2018] Order : These petitions coming on for orders upon perusing the petition and the Memorandum of Grounds in CRL RC.816/2018 on the file of the High Court and upon hearing the arguments of M/S.S.SUGENDRAN, Advocate for the petitioner and of MR. R.SURYA PRAKASH, Govt. Advocate ( Crl.
and sentenced to undergo R.I for one year and also to pay a fine of Rs.1,000/- in default in payment of compensation to the respondent/complainant sentenced the accused to undergo R.I for a period of two months. Challenging the said conviction and sentence, pending revision, the petitioner has filed the present petition.
2. The substantive sentence of imprisonment alone is suspended and the petitioner shall be released on bail on his executing a bond for a sum of Rs.10,000/- with two sureties each for a likesum to the satisfaction of the trial Court and on a further condition that the petitioner shall report before the trial Court on any working day of a month at 10.30 a.m, pending disposal of the revision. It is stated that the petitioner is already paid Rs.1,000/- fine amount imposed by the Court below.
3. In view of the suspension of sentence, the petitioner is exempted from surrendering before the appellate Court and Crl.M.P.No.9254 of 2018 is ordered accordingly. -sd/- 20/07/2018 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
