The petitioner/A3, who was arrested and remanded to judicial custody on 12.07.2022 on execution of Non-Bailable Warrant issued by the learned Judicial Magistrate-IV, Tiruppur for the offence under Section 392 @ 397 of IPC in P.R.C.No.06 of 2018, seeks bail. 2.It is the case of the prosecution that, on the date of occurrence, the petitioner along with two others snatched 3 sovereigns of gold chain from the de-facto complainant at knife point. Hence, the complaint.
3. The petitioner was arrested and released on bail in Crime No.299 of 2017. After completion of investigation, respondent police filed final report and the same is pending for committal in P.R.C.No.6 of 2018 on the file of learned Judicial Magistrate - IV, Tiruppur. At this juncture, the petitioner was absent on 18.11.2018 and as such, NBW was issued. After four years, the petitioner was secured and remanded to 1/3
judicial custody on 12.07.2022. Only because of the absence of the petitioner, the matter is staled. That apart, so far the petitioner is involved in 10 previous cases of similar in nature.
4. Considering the above facts and circumstances and further this is the second bail petition and there is no change in circumstances, this Court is not inclined to grant bail to the petitioner.
5. Accordingly, this Criminal Original petition is dismissed. 29.08.2022 mpl 2/3
