Respondents Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Mandamus to direct the 3rd respondent to include the petitioner name as husband in the death certificate of his wife namely, Manjula died on 19.10.2022 issued by the 3rd respondent dated 22.09.2023 and issue fresh death certificate. ORDER
This Writ Petition has been filed for a direction, directing the third respondent to include the name of the petitioner as husband in the death certificate of his wife, who died on 19.10.2022.
2. Heard the learned counsel appearing on either side and perused the materials available on record.
3. The petitioner got married to one Manjula on 19.01.2014 at Chikka Thirupathi Temple, Hosur. They have no issues. Due to misunderstanding, they got separated. Though the elders put hectic efforts for their reunion, it went in vain. They had jointly purchased a property. Thereafter, the petitioner's wife filed a suit in O.S.No.17 of 2019 on the file of the District Munsif Court, Hosur, seeking maintenance as against the petitioner. While being so, his wife committed suicide, due to her illness, on 19.10.2022. The third respondent issued death certificate dated 22.09.2023, in which the petitioner's name was not mentioned as husband. Therefore, the petitioner submitted a representation to include his name as husband in the death certificate of his wife. It was not considered. Hence, this writ petition.

Considering the facts and circumstances of the case, the third respondent is directed to conduct enquiry in this regard and peruse the documents produced by the petitioner in support of his contention and decide whether to include the petitioner's name as husband in the death certificate of his wife or not, within a period of six weeks from the date of receipt of a copy of this order.
5. With the above direction, this writ petition stands disposed of. No costs.
