Respondents H.C.P. has been filed for a writ of Habeas Corpus directing the respondents 1 to 3 to produce the body of the petitioner's husband, namely, Sakthivel, aged about 45 years, who is under the control and illegal custody of the respondents 1 to 3 and hand over the custody of Sakthivel to the petitioner herein. O R D E R

The petitioner is the wife of one Mr.Sakthivel, aged about 45 years. On the allegation that his husband is in the illegal custody of the 3rd respondent, the petitioner has come up before this Court with this Habeas Corpus Petition.

Today, when the matter came up for hearing, the learned Additional Public Prosecutor appearing for the respondents 1 to 3 submitted that the detenu is not in the illegal custody of the 3rd respondent. But, he has been judicially remanded in connection with a case in Kadambathur Police Station Crime No.25 of 2016 for an offence under Section 379 of IPC and thus, he has been lodged in the Central Prison, Puzhal.
