ORDER

The petitioner, who apprehends arrest for the alleged offences under Sections 4(1)(C), 4(1-A)(ii) of the Tamil Nadu Prohibition Act, 2024 in Crime No.4 of 2026, on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that on 17.01.2026, when the respondent police were on regular patrol duty in Adhiyur Village, they found the accused with illegal possession of 40 bottles each containing 90 ml of Carnival XXX Rum and 20 bottles each containing 180 ml of Old Chef XXX Rum. Hence the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent and he has nothing to do with the commission of offence as alleged by the prosecution. The learned counsel would further submit that the materials were not recovered directly from the petitioner and they were recovered behind the petitioner's house and further, the petitioner was not at all available in the village on the said date. He would also submit that the petitioner is ready and willing to abide by any condition that may be imposed by this Court and prays to grant anticipatory bail to the petitioner.

4. At this juncture, the learned Government Advocate (Crl.Side) appearing for the respondent police strongly objected to grant anticipatory bail to the petitioner on the ground that the petitioner has 3 similar nature of previous cases.

5. Heard the submissions made by the learned counsel on either side and perused the materials available on record.

6. Considering the submissions made by the learned Government Advocate and upon the fact that the petitioner has 3 previous cases of similar nature, this Court is of the firm view that it is not desirable to enlarge the petitioner on anticipatory bail.

7. Accordingly, this Criminal Original Petition is dismissed. 22-06-2026 MJS Note:
