ORDER

The petitioner apprehends arrest for the alleged offence under Sections 465, 467, 468, 471, 472 and 420 of Indian Penal Code, 1860 in Crime No.33 of 2024 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that on 10.06.2024, one Umakeshwari lodged a complaint alleging that the petitioner and other accused persons

created bogus documents and attempted to grab the property of the defacto complainant. Hence, the case was registered.

3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and has no connection with the alleged offence. It is further submitted that the main accused persons have already been arrested and released on bail and some of the co-accused have been granted anticipatory bail by this Court. The learned counsel would also submit that the petitioner is a law-abiding citizen having permanent residence and is ready to abide by any condition imposed by this Court. Therefore, he prayed to grant anticipatory bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent would submit that according to the prosecution, the petitioner along with other accused fabricated the death certificate of a living person and used the same for the purpose of grabbing property. It is further submitted that the petitioner has one previous case. Hence, he opposed to grant anticipatory bail to the petitioner.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. This Court is of the view that the allegation against the petitioner is not a simple property dispute. According to the prosecution, the petitioner along with other accused fabricated the death certificate of a living person. Such an allegation would clearly demonstrate the magnitude of the fraud alleged against the petitioner. Apart from that, the petitioner is also involved in one previous case. Considering the seriousness of the allegation and the possibility of recidivism, this Court is not inclined to grant anticipatory bail to the petitioner.
