The petitioner namely Harikrishnan, who was arrested and remanded to judicial custody on 15.06.2023 for the offences punishable under Sections 406, 419, 420 and 120B of IPC Crime No.99 of 2023 on the file of the respondent police, seeks bail.
2. The learned counsel for the petitioner submitted that, petitioner is falsely implicated in this case in Crime No. 99 of 2023 for the offences under Sections 406, 419, 420 and 120B of IPC. Petitioner is in judicial custody from 15.06.2023. He further submitted that, this petitioner is arrayed as 3rd accused in this case. Only at the request of 1st accused, he had spoken with the defacto complainant. Petitioner did not know anything about the money transaction that had taken place. Petitioner is innocent. Thus, he prays for grant of bail.
3. The learned Government Advocate (Crl. Side) opposes this petition, on the ground that, petitioner claimed himself as Dinesh, who is working in Hon'ble Chief Minister's Office and made the defacto complainant to pay Rs.25,00,000/-, for realising money deposited by the defacto complainant in 1/3
Hijau Associate Pvt ltd. However, the accused had neither helped in realising the amount deposited by the defacto complainant in Hijau Associate Pvt ltd, nor returned the sum of Rs.25,00,000/- received from the defacto complainant. It is his further submission that, investigation in this case is not completed. Therefore, he prays for dismissal of this bail petition.

Considering the nature of the allegations made in the first information report, especially with regard to this petitioner that this petitioner had impersonated as one Dinesh, who is working in Hon'ble Chief Minister's Office and helped other accused in cheating the defacto complainant to the tune of Rs.25,00,000/- and considering the fact that investigation in this case is not completed, this Court is not inclined to release the petitioner on bail. Accordingly, this Criminal Original Petition is dismissed. 31.07.2023 gd 2/3
