The petitioner herein challenged the notice issued by the third respondent calling for applications for appointment of non-hereditary trustees to the Sri Tiruvengamudayan Thirukovil Trust, situated at No.42, Anna Street, Chitlapakkam, Chennai 600 064.

2. The impugned notification was challenged by the petitioner mainly on the ground that the same was issued even without hearing the petitioner who is the Chairman-cum-Trustee of the Temple. 2/4

When the Writ Petition is taken up for hearing, Mr.N.R.R.Arun Natarajan, learned Special Government Pleader appearing for the respondents 1 to 3 on instructions submitted that in response to the impugned notice issued by the third respondent, the Department has not received any application from the persons interested in appointment of non-hereditary trustees. Therefore, there is no possibility of appointing any non hereditary trustee in pursuance of the impugned notification. Therefore, recording the said statement of the learned Special Government Pleader, the Writ Petition is closed.
