This application has been taken out by the first defendant, seeking condonation of 1746 days in representing the written statement.

2. I have gone through the affidavit, filed in support of the application and I am satisfied with the reasons assigned in the affidavit. In fact, the Court also permitted the first defendant to participate in the trial on the assumption that the written statement has been taken on file.

3. Learned counsel for the plaintiff also submits that there is no objection for the written statement being represented and the delay being excused.

4. Accordingly, the delay is condoned and the application is allowed.
