ORDER : The Court Made the following order :- The petitioner who was arrested and remanded to judicial custody on 24.09.2021 for the offence under Section 399 IPC in Cr.No.774 of 2021 on the file of the respondent police, seeks bail. 2.It is the case of the prosecution that the petitioner is alleged to have been preparing to commit dacoity. 3.The learned counsel appearing for the petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution. He would further submit that when the petitioner appeared before the lower Court in connection with a criminal case, the law enforcing agency secured the petitioner and registered a false case and would further submit that the petitioner is ready to abide by the conditions to be imposed by this Court. 4.The learned Government Advocate (Crl.

Side) would submit that the petitioner is history sheeted accused and would further submit that earlier, the petitioner approached this Court by filing Crl.O.P.No.19132 of 2021 and this Court dismissed the said petition on 08.10.2021. He would further submit that there is one previous case as against the petitioner for the offence under Section 302 of I.P.C.

5.Considering the nature of the allegations levelled against the petitioner and since there is no change in circumstances subsequent to the order passed in Crl.O.P.No.19132 of 2021, this Court is not inclined to grant bail to the petitioner.
