This Writ Petition has been filed to quash the show cause notice dated 11.07.2023 in Ref.No.14234/Pers.IR.2/2020 issued by the respondent.
2. The petitioner is facing departmental proceedings for two charges framed by the Department. Domestic enquiry has been conducted and witnesses have been examined and inquiry officer has found that the charges framed against the petitioner have been proved. Thereafter, displiniary authority issued a show cause notice to the petitioner along with enquiry report for submitting explanation by the petitioner. The same has been put in challenge.
3. It is to be noted that after department enquiry, when the show cause notice has been issued before taking any call on the punishment, such a show cause notice cannot be questioned in a Writ Petition and it is for the petitioner to give his explanation. Hence, there is no merits in this Writ Petition.
4. Accordingly, this Writ Petition is dismissed. Consequently, 2/4
