This Civil Revision Petition has been preferred seeking a direction for speedy disposal of O.S.No.969 of 2012 pending on the file of the II Additional District Munsif, Salem.

2.Heard the learned counsel for the petitioner and perused the entire materials available on record.

3.The revision petitioner is the defendant, against whom, the respondent/plaintiff has filed the suit for partition. 4.The learned counsel for the petitioner submitted that the very same plaintiff has filed another suit in respect of another property also partitioned in O.S.No.774 of 2014. Since both the cases are between the same parties, it seems joint trial has been ordered. 5.The records would show that the learned trial Judge seems to have been waiting for the records in other case in O.S.No.774 of 2014. Despite the suits have been filed in the year 2012 and 2014 respectively, they are pending without any progress. It is understandable that the Court would not function effectively during the lock down due to Covid Pandemic. However, the normalcy is restored now, I feel it is appropriate 2/4

to impress the learned trial Judge to dispose both the suits as expeditiously as possible. Since the adjournment status of the case would only show that the case has not yet been listed for trial, it is obligatory on the part of the learned trial Judge to bestow his best attention to dispose these old cases in a time bound manner. Hence the learned trial Judge is impressed to dispose of the suit proceedings as expeditiously as possible. 6.With the above observations, this Civil Revision Petition is disposed of. The learned II Additional District Munsif, Salem, is directed to dispose the suit in O.S.No.969 of 2012 as expeditiously as possible, preferably within a period of six months from the date of receipt of the copy of this order. No costs.
