Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus forbearing the respondents from in any manner interfering nor disturbing with the day to day affairs and functioning of the petitioner's mandram by namely Thendral Manamahiz Mandram - Vadalur, No.6, Kotakara Naidu Street, Pallivasal Back Side, Vadalur, Cuddalore District or its members right

to avail the facilities provided for playing rummy not involving any element of gambling.

O R D E R

After some arguments, the learned counsel appearing for the petitioner on instructions, seeks the permission of this Court to withdraw this writ petition with liberty to file a petition for contempt alleging contempt of the order dated 29.10.2015 made in W.P.No.32089 of 2015, on the ground that the cause of action for filing contempt still survives on account of the harassment given by the third respondent on daily basis; and has also made an endorsement to that effect in the petition. In the light of the endorsement made by the learned counsel appearing for the petitioner, this writ petition is dismissed as withdrawn and the liberty sought for by the petitioner is granted. No costs. Consequently, the connected miscellaneous petition is also closed.
