This writ petition has been filed seeking issuance of a writ of mandamus directing respondents to survey and demarcate the schedule mentioned property of petitioner comprised in Survey No.509/9A vide Patta No.986.
2. By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.
3. The case of the petitioner is that the property comprised in Survey No.509 measuring total extent of 11 acre 98 cents originally belongs
to one Madhavan in which petitioner has purchased a portion of vacant land measuring an extent of 1800 sq.ft by virtue of sale deed dated 25.03.1992 registered as Document No.1850 of 1992. Petitioner obtained patta in her name vide Patta No.986 in respect of the property comprised in Survey No.509/9A which was sub-divided from Survey No.509. An application was submitted before respondents on 10.02.2023 to survey and demarcate the schedule mentioned property by remitting appropriate fee. Since the same was not considered, the present writ petition has been filed.
4. At the outset, it is submitted by learned Government Advocate appearing for respondents that they will consider petitioner's application within a period of eight weeks, which was agreed to by learned counsel for petitioner.
5. In view thereof, this Writ Petition stands disposed of with a direction to the concerned respondent to consider petitioner's application dated 10.02.2023 with regard to survey and demarcation of the schedule
mentioned property and pass appropriate orders after putting petitioner, adjacent land owners and any other interested parties / rival claimants, if any, on notice within a period of eight weeks from the date of uploading of the web copy without waiting for the receipt of certified copy. It is made clear that this Court has not expressed any view with regard to the merits of the case and it is open to the concerned respondent to consider the case on its own merits and in accordance with law.
