528 BNSS, pleased to direct the 1st respondent to conduct further investigation and take necessary action on the petitioners representation dated 05.08.2024 and 06.08.2024 and include the petitioners names in the list of victim witnesses and record their statements under Section 161(3) Cr.P.C., in Crime No.2 of 2024 pending on the file of the 2nd respondent and consequently to direct the 2nd respondent to file final report within a stipulated time.

The petitioner herein seeks further investigation of the complaint regarding cheating.

The learned Government Advocate (Crl.Side) appearing for the respondent police submits that offering lucrative return, several gullible investors been induced and cheated by the accused persons. Hence, initial complaint registered and investigated by DCB was later transferred pursuant to the High Court order to EOW, Erode and the investigation is under way in Crime No.2 of 2024. 3.
The learned Government Advocate (Crl.Side) further submits that as far as 12 petitioners herein, six petitioners have now given 2/4
complaint and the complaint has been taken up for investigation. The rest of six petitioners, once they give complaint, that will also taken up for investigation. That apart, submits that so far 271 complaints been received and every day new complaints are also lodged. The EOW Wing has constituted a special team to investigate the matter and on completion of investigation, final report will be filed. He also submits that certain property of the accused person has been identified and steps for attachment likely to be initiated soon.

In view of the above facts, this Court disposed the Criminal Original Petition with direction to EOW, Erode to expedite the investigation and identify the property which are acquired by the accused persons from out of proceeds of crime and take necessary action. 04.09.2024 Index : Yes/No rpl Dr.G.JAYACHANDRAN,J.
