Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents to consider the petitioner representation dated 24.06.2024 and to issue patta in the name of the petitioner in S.No.138/2 extent 1 acre 86 cents in Pazhaveri Village, Uthiramerur Taluk, Kancheepuram District.

The petitioner herein seeks a direction to the respondents to consider his representation dated 24.06.2024 and pass necessary orders for issuance of patta in the name of the petitioner in respect of the land situated in S.No.138/2 at Pazhaveri Village, Uthiramerur Taluk, Kancheepuram District, with an extent of 1 acre 86 cents.

2. It is the case of the petitioner that he belongs to oppressed class and he has been in possession and enjoyment of the above mentioned land for the past 60 years by doing cultivation. He submitted a representation seeking issuance of patta in his name and the same has not been considered.

Mr.A.Selvendran, learned Special Government Pleader takes notice for the respondents 1 to 4 would submit that the petitioner seeks issuance of patta in respect of 1 acre 86 cents of Government land and value of the land exceeds Rs.7,50,000/-. As per G.O.No.496 Revenue Department dated 24.12.2018, if the value of the land exceeds Rs.7,50,000/-, it has to be dealt with by the Revenue Department.

In view of the submission made by the learned Special Government Pleader appearing for the respondents, without going into the merits of the case, this Court is inclined to issue a direction to the first respondent to consider the representation on merits and if he founds that the value of the land exceeds Rs.7,50,000/-, it is open to him to forward the representation to the concerned Secretary for final decision. In case, the 3/6

representation is forwarded to the Secretary of Revenue Department, he shall consider the same and pass final orders, within a period of 16 weeks from the date of receipt of copy of this order. The Registry is directed to send a copy of the order to the Secretary of Revenue Department.

5. With the above direction, this Writ Petition is disposed of. No costs.
