This Criminal Original Petition is filed to expedite the investigation in Cr.No.410 of 2016 on the file of the respondent police and to file final report within a stipulated period. 1/3

The learned Government Advocate (Crl.Side) appearing for the respondent police on getting instructions from the Investigating Officer submits that investigation in this case was completed and closed as ' mistake of fact' . RCS report filed before the learned Magistrate on 10.11.2018. However, the learned Government not sure whether the RCS notice served to the complainant or not through Court.

3. In the light of the above fact, it is sufficient to dispose of this Criminal Original Petition with the direction that the petitioner herein shall file protest petition, if he is aggrieved by the closure of the complaint as ' mistake of fact ' .
