PRAYER: Tr.C.M.P. filed under section 24 of C.P.C., to withdraw and transfer the original petition in HMOP No.9 of 2011 from the file of learned Subordinate Judge at Cheyyar, Thiruvannamalai District to the file of the learned Subordinate Judge at Ranipet, Vellore District to try the same along with HMOP No.30 of 2016.

During the currency of this transfer petition, the Trial Court passed an ex parte decree in HMOP No.9 of 2011. In view of same, the learned counsel for the petitioner seeks withdrawal of the transfer petition with liberty to file fresh petition after restoration of the proceedings in HMOP No.9 of 2011. He has also made an endorsement to that effect.
