PRAYER: Tr.C.M.P. filed under section 24 of C.P.C., to withdraw the casein HMOP NO.237 of 2016 on the file of SubCourt, Tambaram and transfer the same to the file of Family Court at Chennai.

O R D E R

The respondent instituted proceedings for divorce before the Sub-Court, Tambaram. The petitioner, who is the respondent in the said proceedings filed this petition for transfer.

2. The learned counsel for the respondent fairly submitted that the respondent has no objection for transferring the proceedings from Sub-Court, Tambaram to Family Court, Chennai.

3. The petitioner is a resident of Chennai. Even the respondent is a resident of Pallavaram, Chennai. The prayer in the transfer petition is to withdraw the proceedings from the file of Sub-Court, Tambaram and transfer the same to the file of Family Court, Chennai. Now that the respondent has no objection in transferring the matter, necessarily, the transfer petition deserves to be allowed.

4. The proceedings in H.M.O.P.No.237 of 2016 is withdrawn from the file of Sub-Court, Tambaram and is transferred to the file of Family Court, Chennai, for disposal on merits.

5. The Transfer Civil Miscellaneous Petition is allowed as indicated above. No costs. Consequently, connected miscellaneous petition is closed.
