Sugumar ..Respondent(s) Prayer: This writ petition is filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the Respondents 1st to 3rd to consider the petitioner's representation dated 26.02.2026 to conduct the survey of the land measuring an extent of 18 3/4 cents in survey No.509/A2, 26 Cents in Survey No.511/5, 30 cents in Survey Nos.511/6B and 7B, 6 cents in Survey No.510/A1 and 7 cents in Survey No.511/4B, situated at Chinnasalem (South Village, Chinnasalem Taluk, Kallakurichi District and to demarcate the boundaries and issue patta to the petitioner, based on the registered will dated 19.02.1989, registered as Document No.03/1989 in the office of SRO, Chinnasalem.

ORDER

This Writ Petition has been filed to direct the respondent to consider the petitioner's representation dated 26.02.2026.

Learned counsel for the petitioner would submit that the petitioner has made a representation dated 26.02.2026 to conduct the survey of the land measuring an extent of 18 3/4 cents in survey No.509/A2, 26 Cents in Survey No.511/5, 30 cents in Survey Nos.511/6B and 7B, 6 cents in Survey No.510/A1 and 7 cents in Survey No.511/4B, situated at Chinnasalem (South Village, Chinnasalem Taluk, Kallakurichi District and to demarcate the boundaries and issue patta to the petitioner, based on the registered will dated 19.02.1989, registered as Document No.03/1989 in the office of SRO, Chinnasalem. However, the same was not considered, as on date. Hence, this writ petition.

3. Mr.M.Guruprasad, learned Government's Counsel accepts notice on behalf of the respondent and submitted that the petitioner's representation dated 26.02.2026 will be considered within a period of eight weeks.

4. Heard the learned counsel on either side and perused the materials available on record.

5. Considering the limited relief sought by the learned counsel for the petitioner, this Court without expressing any opinion on the merits of the case, directs the respondents 1 to 3 to consider the petitioner's representation dated 26.02.2026 and carry out a survey and complete the process, after giving prior notice to the petitioner and other aggrieved parties, if any, within a period of eight (8) weeks from the date of receipt of a copy of this order.

6. It is made clear that this order is passed only for the purpose of issuing a direction to the official respondent to conduct a survey and lay boundary stones at the subject land. In the event any dispute arises regarding the possession of the subject property, the same has to be decided by way of filing a suit before the competent Civil Court.

7. With the above direction, this writ petition stands disposed of. No costs.
