Prayer : Transfer Civil Miscellaneous Petition under Section 24 of C.P.C., to withdraw HMOP No.111 of 2021 on the file of the Sub Court at Sattur and transfer the same to the Family Court, Chennai and try the same along with MC No.449 of 2021 on the file of Hon'ble II Additional Family Court at Chennai. Despite service, the respondent is not appearing either in person or through counsel duly instructed.

The petitioner/wife seeks transfer of HMOP No.111 of 2021 on the file of Sub Court, Sattur to the file of II Additional Family Court, Chennai to be tried along with MC No.449 of 2021 pending on its file. Though several claims are made regarding the place of marriage etc., I do not propose to go into those issues.

3.Considering the convenience of the wife, who is a resident of Otteri, Chennai and the fact that the maintenance case is https://hcservices.ecourts.gov.in/hcservices/

pending before the II Additional Family Court, Chennai, H.M.O.P.No.111 of 2021 is withdrawn from the file of the Sub Court, Sattur and transferred to the file of II Additional Family Court, Chennai to be tried along with M.C.O.P.No.449 of 2021 and disposed of in accordance with law. Accordingly, the Tr.C.M.P.No.831 of 2021 is allowed. No costs. Consequently, connected miscellaneous petition is closed.
