PRAYER : Civil Revision Petition filed under Art. 227 of Constitution of India, praying to dispose the suit in O.S.No.10 of 2019 on the file of District Munsif, Madukkarai, Coimbatore District in the speedy manner that may be fixed by this Court.

O R D E R

The Revision Petitioner herein is the 3rd plaintiff in the suit in O.S.No.10 of 2019, which was filed by her along with other plaintiffs for the relief of declaration of legal heirs of Palaniappa Chettiar against the defendants 1 to 5. But, thereafter, the case was adjourned for many occasions for evidence. In the meanwhile, Interlocutary Applications were also filed and the same are pending before the trial court. However, without any progress, the case was adjourned for many occasions. Hence, she filed the present Civil Revision Petition praying for a speedy disposal. 2/5

2. As the relief claimed by the Revision Petitioner only seeking for a direction to speedy disposal, the notice to the respondent is dispensed with.

3. Records as well as e-court status perused. On seeing the e-court status and on perusal of records, it would reveals that from the year of 2019, the suit was adjourned for evidence. Admittedly, the Revision Petitioner is aged about 64 years old lady and a senior citizen. If opportunity is not given to her at the earliest point of time, her valuable right in respect of the property will be defeated. Therefore, on considering the reasons made by the Revision Petitioner, this Court is inclined to direct the learned District Munsif, Madukkarai, Coimbatore to dispose the suit in O.S.No. 10 of 2019 on merit as expeditiously as possible within a period of four months from the date of receipt of copy of this order. Accordingly, this Civil Revision Petition is disposed of. No costs.
