C.M.P.No.7008 of 2022 in C.M.A.SR.No.94923 of 2021 SUNDER MOHAN,J.

This Petition has been filed to condone the delay of 4709 days in filing the above C.M.A.

2. Though notice has been served to the respondent and the learned counsel had entered appearance, inspite of several opportunities, he has not chosen to file counter. There is no representation for the respondent today.

3. Heard the learned counsel for the petitioner.

4. Considering the averments made in the affidavit filed in support of this petition and being satisfied with the same, the delay is condoned on condition that the petitioner/appellant shall forfeit the interest for the delay period in the event of this Court enhancing the compensation. The appellant shall also pay cost of Rs.2,000/- to the Tamil Nadu State Legal Services Authority, High Court Campus, Chennai within a period of two weeks.

5. Registry is directed to number the C.M.A., if it is otherwise in order and list the same in due course.
