Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the order passed by the 1st Respondent in G.O.Ms.No.65, Personnel & Administrative Reforms Department, dated 27.05.2009 in so far as it directs to apply the revised roster for the recruitment made on and after 29-04-2009 and the consequential Notification issued by the 3rd respondent published in Deccan Chronicle dated 18.05.2012 and quash the same and direct the respondents to fill up the posts applying the rule (i.e.) 100-point roster, which was in force on the date when the vacancies arose.

By consent of both sides, the writ petition itself is taken up for final disposal. Heard the learned counsel for the petitioner, learned Additional Government Pleader for respondents 1 & 2 and the learned Standing Counsel for the third respondent-University of Madras.

2. The learned counsel for the petitioner submitted that the averments made in Paragraph 11 of the counter affidavit filed by the third respondent may be recorded and the writ petition may be closed. In paragraph 11, the third respondent-University has taken the following stand:

"..... As per G.O.241, it has been clearly indicated that the 200 point roster shall start afresh from serial number one i.e. from GT. Once the revised roster has started, as per G.O.206 and 65 it shall be continued from that point onwards. But as per the above advertisement no appointments have been made. Hence, the present advertisement starting from GT for each department after cancelling the earlier one by the Syndicate for the above reasons and more than a year has elapsed."

3. The learned counsel for the petitioner brought to the attention of this Court that subsequently a Notification has been issued by the respondent-University calling for application for the post of Assistant Professors in various departments in conformity with 200 point roster system.

4. In the light of the above, nothing survives for adjudication in this Writ Petition and the same is dismissed as infructuous. No costs. Consequently, M.P. Nos. 2 of 2012 and 1 of 2014 are also dismissed.
