The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 7, 20(1) of Cigarette and other Tobaco Products Act, 2003, 52, 59 of Food Safety and Standards Act, 2006 and 328 of IPC, in Crime No.128 of 2022, seek anticipatory bail.

2. There are totally twenty one accused, in which the petitioners are arrayed as A3, A4, A5, A6, A10, A13 and A14. The case of the prosecution is that on 01.07.2022, the respondent police found that the petitioners along with other accused were in illegal possession of 4063 Kgs of banned tobacco products. Hence, the case.

3. The learned counsel for the petitioners submitted that the petitioners are innocent persons and no way connected with the alleged offence. Hence, he prays to grant anticipatory bail to the petitioners.

4. The learned Additional Public Prosecutor submits that the petitioners along with other accused were found in illegal possession of 4063 Kgs of banned tobacco products. He would further submit that there is one https://www.mhc.tn.gov.in/judis

Anu previous case pending as against A6. Hence, he vehemently opposed to grant anticipatory bail to the petitioners.

5. Taking into consideration the fact that the petitioners were in possession of huge quantity of banned tobacco products, the custodial interrogation of the petitioners is very much required in this case. Hence, this Court is not inclined to grant anticipatory bail to the petitioners.
