ORDER

The petitioner seeks to defreeze the account.

2. According to the petitioner, he has opened the account with the second respondent for his business purposes, whereas, now, his account has been frozen without any notice to him.

The learned counsel for the second respondent submitted that account has been frozen as per the order of the Cyber Cell/3rd respondent and also the order of the learned Additional Chief Judicial Magistrate, Gandhidham-Kachchh. The document produced by the petitioner today reveals that on the complaint of one NarendraKumar Pukhraj before the Cyber Crime and the learned Additional Chief Judicial Magistrate, Gandhidham-Kachchh had directed to transfer the amount of Rs.34,000/- to the complainant from two accounts, viz., 043537845659754 to the tune of Rs.15,000/- and 121119384589819 to the tune of Rs.19,000/-.

4. Now, it appears that the bank has also transferred the amount of 19,000/- from the bank account in A/c.121119384589819 as directed by the Court to the complainant. When the Court itself has directed to transfer of only 19,000/- from bank account in A/c.121119384589819 and the amount is also transferred, still, the question of freezing the petitioner's bank account does not arise at all. Hence, the second respondent is directed to defreeze the bank account within a period of one week from the date of receipt of a copy of this Order.
