Dispute regarding property has led to complaint before the Deputy Superintendent of Police, Thiruvallur in CP417/DSP/DCB dated 1/4

11.08.2023. Thereafter, the complainant has instituted a suit for declaration before the Principal District Judge, Thiruvallur in O.S.No.50 of 2024 on 23.01.2024 and the same is pending. While so, pursuant to the complaint forwarded by the office of the Deputy Superintendent of Police , it appears that the respondent police is investigating the matter under the guise of investigation. It is alleged that the petitioner is harassed.

2. From the record, this Court finds that the petitioner Munusami is the 1st defendant in OS.No.50 of 2024 filed for declaration in respect of Document No.12576/2023 on the file of SRO, Thiruvallur as null and void.

3. The respondent police is directed to look into the civil suit pending and decide the complaint in accordance with law. In any event, they shall not harass the petitioner under the guise of investigation.

4. With this observation, this Criminal Original Petition is disposed of.
