ORDER
The petitioner/sole accused, facing trial in Spl.S.C.No.235 of 2026 on the file of the Magalir Neethi Mandram (Fast Track Mahila Court), Thiruvallur, for the offences under Section 87 BNS, Sections 5(l), 5(j)(ii), 6(1) of Protection of Children from Sexual Offences (POCSO) Act, 2012 and Section 9 of the Prohibition of Child Marriage Act, 2006, has filed the present quash petition. 2.The case of the prosecution is that the petitioner and the victim girl, who was aged about 17 years at the time of occurrence, were in love with each for more than two years. Pursuant thereto, on 28.02.2025 at about 06.00 p.m.
, the petitioner, knowing very well that the victim girl is a minor, married her in Kali Temple at Thiruvalangadu and thereafter, they rented a house, where, the petitioner committed penetrative sexual assault on the victim girl on several occasions, due to which, she became pregnant. Hence, the 1st respondent Police registered a case in Crime No.33 of 2025 as against the petitioner. After investigation, the Police filed a final report for the offences under Sections 87 BNS, Sections 5(l), 5(j)(ii), 6(1) of Protection of Children from Sexual Offences (POCSO) Act, 2012, and Section 9 of the Prohibition of Child Marriage Act, 2006, as against the petitioner, which was taken on file in Spl.S.C.No.235 of 2026 on the file of the Magalir Neethi Mandram (Fast Track Mahila Court), Thiruvallur.
To quash the same, the present petition has been filed.
3.Now, the case is at the stage of trial. Pending trial, the parties have now arrived at a compromise and they are willing to settle the matter amicably. Learned counsel on either side submitted that the petitioner and the victim girl were in love with each other and they married with consent. Now, they are living happily and they have a male child out of the wedlock. 4.Learned Government Counsel (Criminal Side) appearing for the 1st respondent Police submitted that, on enquiry, it was found that the victim girl has now attained majority and the petitioner and the victim girl are now happily living together as husband and wife and they have a male child born to them on 02.12.2025.
5.Today, the petitioner, victim girl and the mother of the victim girl appeared before this Court and they are identified by Mrs.G.Bharathi, Women Head Constable 312, AWPS, Tiruttani.
6.The petitioner and the victim girl appeared along with the male child born to them on 02.12.2025. In support of the same, the Birth Certificate of the child is also produced before this Court. On enquiry, the victim girl and her mother submitted that they are not inclined to prosecute the petitioner in view of their peaceful future prospects. The parties have filed a joint memo of compromise, dated 15.06.2026, which is scanned and reproduced hereunder :
7.The Apex Court in the case of K.Dhandapani vs. State by the Inspector of Police reported in 2022 SCC Online SC 1056, considered the subsequent events and observed that the Court cannot shut its eyes to the ground reality and disturb the happy family life of the accused as well as the victim. This case involves the future of two young persons and quashing the same will in fact pave way for the accused as well as the victim to settle down in their life and look for better future prospects. No useful purpose will be served in continuing with the criminal proceedings and keeping these proceedings pending will only
swell the mental agony of the accused and the victim girl and their families as well. In view of the same, this Court finds that continuation of the proceedings will serve no purpose and it is only an abuse of process of law and is therefore, inclined to quash the same.
8.Accordingly, this Criminal Original Petition is allowed and as a sequel, the case in Spl.S.C.No.235 of 2026 on the file of the Magalir Neethi Mandram (Fast Track Mahila Court), Thiruvallur, is hereby quashed against the petitioner.
