This miscellaneous petition has been filed to condone the delay of 89 days in filing the above appeal.

2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent and also perused the materials available on record.

3. On being satisfied with the reasons stated in the affidavit filed in support of this petition and also the fact that the accused is in custody, this Court is inclined to allow this petition and the delay of 89 days is condoned.

4.Registry is directed to number the appeal, if it is otherwise in order.
