This Criminal Original Petition has been filed to direct the respondents not to harass the petitioner under the guise of conducting a petition enquiry with regard to the complaint made by one Mr.Jaya Kumar, S/o Kanappan on the file of the second respondent- Police.
2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondentPolice and perused the materials available on record.
3. Learned Government Advocate (Crl.Side) appearing for the respondent-Police submitted that though the petitioner was summoned for enquiry, he did not turn up. In reply, the learned counsel for the petitioner submitted that during the month of March 2025, he appeared before the respondent Police for enquiry, however, no document has been produced by the petitioner to show that during the month of March, he received the summon. Further, the learned counsel for the petitioner
admitted that for the summon which was issued on 14.6.2025, the petitioner did not appear for enquiry before the respondent Police.
4. Considering the facts and circumstances of the case and also considering the submissions made by the learned counsel on either side, this Court finds that the petitioner is not entitled to the relief as sought for in this criminal original petition. The petitioner is directed to co-operate with the respondent -Police for completion of enquiry.
5. With the abovesaid direction, this Criminal Original Petition is dismissed.
