PRAYER: Writ Petition has been filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondents to appoint the petitioner as Junior Assistant or any other suitable post in the Forest Department of 4th respondent Division under compassionate ground in order to protect her family livelihood forthwith. ORDER
This Writ Petition has been filed for a mandamus seeking for a direction to the respondents to appoint the petitioner as Junior Assistant or any other suitable post in the Forest Department of the fourth respondent Division under compassionate ground based on the petitioner's representation dated 13.08.2008 within a time frame to be fixed by this Court.
2. The petitioner's father one C.Radhakrishnan died on 10.02.2008 while in service in the Forest Department. The petitioner seeks for compassionate appointment. According to her, she has applied for the same immediately after the death of her father. She has also given several 2/6
representations seeking for compassionate appointment, but the same has not been considered till date. In such circumstances, she has filed this Writ Petition.
3. Heard, Mr.M.R.Jothimanian, learned counsel for the petitioner and Mr.T.Seenivasam, learned Special Government Pleader appearing for the respondents.
4. Learned counsel for the petitioner would now submit on instructions that the petitioner is willing to give a fresh representation.
5. No prejudice would be caused to the respondents if the petitioner's application dated 13.08.2008 is considered on merits and in accordance with law within a time frame to be fixed by this Court.
6. The petitioner seeks for compassionate appointment due to the death of her father while in service in the year 2008. 3/6
7. For the foregoing reasons, this Court directs the second respondent to pass final orders on the petitioner's application dated 13.08.2008, seeking for compassionate appointment, within a period of twelve weeks from the date of receipt of a copy of this order.
8. With the aforementioned directions, this Writ Petition is disposed of. No Costs.
