C.M.P.No.16728 of 2023 has been filed to condone the delay of 918 days in filing the petition to set aside the abatement caused due to the death of the first respondent namely K.Govindasamy, in the above condone delay petition in C.M.P.No.7808 of 2023 in C.M.A.SR.No.43777 of 2023.
2. C.M.P.No.16736 of 2023 has been filed to set aside the abatement caused due to the death of the first respondent namley K.Govindasamy in the above condone delay petition in C.M.P.No.7808 of 2023 in C.M.A.SR.No.43777 of 2023.
3. M/s.C.Bhuvana Sundari, learned counsel takes notice for the second respondent and submitted that he has no objection in allowing this petition.
4. Though notice was served on the third to fifth respondents, legal heirs of the deceased first respondent, none had entered appearance on their behalf before this Court.
5. Heard both sides.
6. Considering the averments made in the affidavit filed in support of this https://www.mhc.tn.gov.in/judis petition and also the fact that the second respondent has no serious objections in
SUNDER MOHAN,J.
gba allowing this present petition, and being satisfied with the same, the delay is condoned. Hence, C.M.P.No.16728 of 2023 is ordered as prayed for. In view of the order passed in C.M.P.No.16728 of 2023, the C.M.P.No.16736 of 2023 is also ordered as prayed for.
7. Registry is directed to number the C.M.A., if it is otherwise in order and the list the same in due course.
