S.Chandrasekar Prayer:Civil Miscellaneous Petition filed under Order XXXII, Rule 12 of the Code of Civil Procedure, 1908 praying to declare the 3rd defendant/3rd respondent is a major and consequently, the 1st respondent-mother is discharged from the guardianship and also pray to take notice on behalf of the 3rd defendant in the above appeal.

ORDER

Mr.P.Seshadri, learned Counsel for the petitioner and Mr.L.Dhamodaran, learned Counsel for the Respondent Nos.2 and 3 are before this Court.

Both sides learned Counsel submitted that the Respondent No.1, namely, Santhi, W/o. Kumar, passed away on July 24, 2018 leaving behind the Respondent Nos. 2 and 3 herein, as her legal heirs/legal representatives of the deceased.

This Court has perused the case file.

The date of birth of the Respondent No.3 viz., Minor-Krithika is 12.04.1997. Now, she attained major.

5.

Upon being satisfied with the reasons stated in the affidavit filed in support of this petition, this petition is allowed. 11.07.2025 1/2 MSM Note: Registry is directed to carryout necessary amendment in the Appeal Suit and list the same on 31.07.2025.
