The money dispute between the defacto complainant and the petitioner in connection with supply of ever silver utensils has led to C.S.R.No.91 of 2024.

The petitioner herein was summoned to appear for enquiry 1/4

on 27.07.2024. The petitioner has not appeared before the Investigating Officer, but before this Court alleging that the Investigating Officer calling him regularly and forcing him to pay the money. 3.

The learned counsel appearing for the petitioner states that it is purely a money dispute regarding sale of goods in which the police is unnecessarily interfering and trying to give criminal colour. 4.

Time and again this Court has warned the police not to interfere with the civil dispute. However, when there is a complaint alleging commission of cognizable offence, police is bound to enquire the matter and decide in accordance with law. For which, the petitioner/accused is bound to appear before the Investigating Officer and cooperate with the enquiry.

In the said circumstances, it is suffice to direct the petitioner to appear before the Investigating Officer on receipt of summons and cooperate with the enquiry.

With the above direction, this Criminal Original Petition is disposed of .
