This petition is filed to enlarge the petitioner on bail in P.R.C. No.15 of 2023 (Judicial Magistrate Court, Mettupalayam) in Cr.No.282 of 2023 on the file of the respondent Police.

2.It is the submission of learned counsel for the petitioner that petitioner is falsely implicated as accused in Cr.No.282 of 2023 registered for the offences under Section 294 (b), 324, 307 I.P.C. Petitioner is in judicial custody from 07.05.2023. He is innocent. Thus, he seeks bail. 3.In response, the learned Additional Public Prosecutor submitted that petitioner and one Sindhuja were in love with each other. During the course of their love, petitioner had taken photograph of Sindhuja. However, Sindhuja and defacto-complainant got married. Even after the marriage, petitioner started threatening Sindhuja showing the photographs taken. In fact on 06.05.2023, petitioner invited Sindhuja and defacto-complainant to come to Karamadai to speak with them, thereafter, he said, he would not cause any problem. Believing his words on 07.05.2023, at about 03.00 p.m. 1/3

defacto-complainant and Sindhuja went to Karamadai and when talking with petitioner/Manikandan near his house, suddenly petitioner took a knife from his pant pocket and stabbed Sindhuja indiscriminately. When defactocomplainant tried to intervene, he was also attacked. Injured had been treated and discharged.

4.Considered the rival submissions and perused the records. 5.Considering the nature of the serious injuries suffered by the victims, though they are now discharged from hospital, the manner of indiscriminate attack with knife, makes this Court feel that, if the petitioner is now released on bail, there is a possibility of threatening the witnesses. Investigation in this case is not completed. Therefore, this Court is not inclined to grant bail to the petitioner now. He may approach the Court for bail after examination of material witnesses namely the victims in this case. 6.Accordingly, this Criminal Original Petition is dismissed. 01.08.2023 ep 2/3
