As per the case management schedule dated 13.12.2019, the plaintiff witness Mr.P.Kumar mounted the witness box on 11.02.2020 and filed his proof affidavit in lieu of chief examination. Ex.P1 was marked and the matter was adjourned by the learned Additional Master IV to 18.02.2020 for marking of other documents and continuation of P.W.1 chief. However, thereafter there was no progress in this matter. Though it was listed before the Master for more than 12 times from 18.02.2020 to 04.10.2021.

2.The plaintiff has taken out Application No.3804 of 2021 on 20.10.2021 to argue the evidence of P.W.1 Kumar and to substitute P.Jesygaa, Proprietrix of the plaintiff company to give evidence on behalf of the plaintiff.

3.Considering the reason stated in the affidavit for substitute the witness after eschewing the witness already recorded, this court is of the DR.G.JAYACHANDRAN,J.

VRI view that the plaintiff, who has now come forwarded to substantiate her plea, has to be given liberty and hence, this application is allowed. Parties are directed to file their fresh case management schedule on 23.11.2021.
