This petition has been filed seeking to relax the condition imposed by this Court upon the petitioner/appellant in Crl.M.P.No.10701 of 2019 in Crl.A.No.260 of 2019 vide order dated 05.08.2019, to appear before the trial Court, once in a month on the first working day of the English Calender Month at 10.30 a.m., commencing from September 2019, till the disposal of the appeal.

2.The learned counsel for the petitioner submitted that the petitioner is suffering from cancer and he finds it difficult to comply with the condition. Hence, he seeks relaxation of the condition imposed on him by this Court.

3. Mr.Santhosh, learned Government Advocate (crl.side) submitted that the petitioner has been complying with the conditions regularly.

4. Being satisfied with the reasons adduced in the affidavit filed in support of this petition, this criminal miscellaneous petition stands ordered and the condition imposed by this Court in Crl.M.P.No.10701 of 2019 in Crl.A.No.260 of 2019 vide order dated 05.08.2019, is modified to the effect that "the petitioner shall appear before the trial Court, once in every six months on the first working day of the English Calender Month at 10.30 a.m., till the disposal of the appeal". 01.08.2024 vkr https://www.mhc.tn.gov.in/judis
