This petition is filed under Section 438 Cr.P.C., to enlarge the petitioner on bail in the event of his arrest in Crime No.526 of 2011, on the file of the respondent police.

2.The learned counsel for the petitioner submitted that petitioner is an accused in S.C.No.54 of 2016, pending on the file of the Sub Court, Ulundurpet. He did not appear on 26.09.2022 before the concerned Court. Therefore, Non Bailable Warrant was issued. Apprehending arrest, this petition is filed.

3.When Non Bailable Warrant is pending, anticipatory bail petition cannot be entertained. However, this Court directs the petitioner to approach the learned Sub Judge, Ulundurpet, with petitions to surrender and recall of Non Bailable Warrant. On such filing of the petitions, the learned Sub Judge, Ulundurpet, is directed to consider the petitions on merits and in accordance with law and dispose the petitions on the same date.
