This Criminal Original Petition has been filed to call for the records of the 1st respondent in Crime No.183 of 2018 dated 14.05.2018 on the file of the first respondent and quash the same.
2. Today, Mr.K.Rajaprabhu, Grade-I PC 26094, CCB, Vepery, Chennai, is present before this Court.
3. On the complaint lodged by Ramesh Lamba, the second respondent herein, the first respondent police has registered a case in Crime No.183 of 2018 on 14.05.2018 for the offences under Sections 406 and 420 IPC against the petitioner herein, for quashing which, this petition has been filed.
4. Heard Mrs.P.Kavitha, learned counsel for the petitioner, Mr.C.Raghavan, learned Government Advocate (Crl. Side) for the first respondent and Mr.A.Arokiadoss, (Enrol.No.107/1996), learned counsel for the second respondent.
5. The learned counsel for the petitioner and the learned counsel for the second respondent submitted that the matter has been amicably settled and therefore, the FIR in Crime No.183 of 2018 may be quashed.
6. The learned Government Advocate (Crl. Side) also produced a copy of the letter dated 27.06.2018 purportedly issued by the second respondent, which reads as follows: "I have given a complaint dated 14.05.2018, that a sum of Rs.53,48,750/- (Rupees Fifty Three Lakhs Forty Eight Thousand Seven Hundred and Fifty Only) paid by us to Advocate B.Divakaran towards Registration expenses of a property which we propose to be purchase in OMR has not been returned inspite of cancellation of the Registration.
Now, we have received the entire sum of Rs.53,48,750/- paid to the said B.Divakaran and therefore, we do not want to pursue the complaint given by us and kindly request to drop all further proceedings based on the complaint given by us.
We are ready to fulfill all the formalities that may be required legally in dropping all the charges filed under C.C.No.183 of 2018, before the CCB-I"
In view of the above, this petition is allowed and the FIR in Crime No.183 of 2018 is hereby quashed.
