ORDER

Pursuant to the earlier orders passed by this Court, it was brought to the notice of this Court by the learned Advocate General that almost the entire amount has been settled to the petitioner and if at all, there is any discrepancy in the total amount claimed by the petitioner including interest, the petitioner has to necessarily agitate his dispute only by initiating arbitration proceedings.

The learned counsel for the petitioner submitted that there is a dispute with regard to approximately 27 Crores, which is claimed by the petitioner including the interest part and the same has not been paid to the petitioner.

In the considered view of this Court, considering the limited

jurisdiction that can be exercised by this Court under Article 226 of the Constitution of India, the disputed portion of payment and also the interest claimed by the petitioner can be agitated by the petitioner by raising an arbitration dispute as provided under the tender agreement. Except giving this liberty, no further orders can be passed in this writ petition. 4.
