The petitioner/wife has filed the above Transfer Civil Miscellaneous Petition to withdraw H.M.O.P.No.71 of 2016 on the file of the Sub Court, Uthamapalayam, Theni District and transfer the same to the file of the I Additional Family Court, Chennai.

H.M.O.P.No.71 of 2016 is filed by the respondenthusband before the Sub Court, Uthamapalayam, Theni District for dissolution of marriage held between the petitioner and the respondent on 31.10.2008.

It is the grievance of the petitioner/wife that the respondent has compulsorily expelled the petitioner from the matrimonial home and hence she is residing with her parents in Chennai. She finds it difficult to appear before the Court at Uthamapalayam, Theni, which is more than 590 k.m. away. 4.

It is also stated that the respondent has filed the guardian O.P. before the I Additional Family Court, Chennai in G.W.O.P.No.3134 of 2016 and the same is pending. https://hcservices.ecourts.gov.in/hcservices/

Taking into consideration the above grievances expressed by the petitioner, this Court deems it fit to transfer the said H.M.O.P.No.71 of 2016 from the file of the Sub Court, Uthamapalayam, Theni District to the file of the I Additional Family Court, Chennai to be tried along with G.W.O.P.No.3134 of 2016, which is already pending before the I Additional Family Court, Chennai.
