Mr.A.R.Balaji Government Advocate Order This writ petition has been filed seeking the issuance of a writ of mandamus directing the 2nd respondent to confirm the petitioner's probation by giving relaxation in respect of educational qualification as per the direction of this Court in W.P. No.12535 of 2007 and to direct the respondents to promote him in the post of Forester by including his name in the panel drawn on 27.05.2014 for promotion to the post of Forester on par with his juniors with all consequential benefits by considering his representation dated 09.08.2024 within time frame.

The petitioner would submit that he was initially appointed as an Office Assistant on compassionate grounds on 15.09.1997 and was subsequently appointed as a Forest Guard pursuant to G.O.Ms.No.259 dated 08.09.1998. By proceedings dated 23.07.2003, he was reverted to the post of Office Assistant. Challenging the said order, he filed O.A.No.2916 of 2003, which was renumbered as W.P.No.12535 of 2007, and this Court, by order dated 09.04.2011, quashed the order of reversion. Thereafter, when the panel

for promotion to the post of Forester was drawn on 29.05.2014, the petitioner's name was not included. Though this Court, in W.P.(MD) No.11617 of 2014, directed the first respondent to consider his representation, the respondents failed to consider his claim for inclusion in the promotion panel. Hence, the petitioner has filed the present writ petition seeking appropriate relief.

3. Heard the learned counsel for the petitioner and the learned Government Advocate appearing for respondents.

Considering the limited scope of the prayer sought in this writ petition, and without expressing any opinion on the merits of the case, this Court directs the respondents to grant relaxation to the petitioner in respect of the educational qualification for declaration of his probation as per the direction issued by this Court in W.P. No.12535 of 2007 dated 09.04.2011 and to consider the petitioner's representation dated 09.08.2024 for promotion to the post of Forester and pass appropriate orders on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.
