The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 153A (1) (a) and 505 (1) (c) of IPC in Crime No.311 of 2022 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 29.06.2022 in front of the BSNL Office, the petitioner along with 45 others assembled unlawfully on behalf of the SDPI party raised a slogan, protested and condemned against the arrest of Human Rights Fighter viz.., Mr.Sri Kumar IPS and Mr.Subair, Journalist. Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any such offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner. 1/3

The learned Additional Public Prosecutor appearing for the respondent submits thatthe petitioner along with 45 others assembled unlawfully on behalf of the SDPI party raised a slogan, protested and condemned against the arrest of Human Rights Fighter viz.., Mr.Sri Kumar IPS and Mr.Subair, Journalist. He would further submit that the injured is still in hospital and taking treatment. He would further submit that there are twenty four previous cases against the petitioner. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration the facts and submissions of the learned Counsel and also the fact that there are twenty four previous cases against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 26.08.2022 vv 2/3
