Respondents Petition filed under Article 226 of the Constitution of India praying for issue of Writ of Declaration declaring that the action of the 1st respondent in taking physical possession of the petitioner's tenanted house property situated at New No.10, Old No.5, Saradambal Street, Gokulam Colony, T.Nagar, Chennai600 017 on 19.07.2019 in violation of the order dated 27.06.2019 of the Debts Recovery Tribunal II in I.A.No.1091 of 2018 in S.A.No.370 of 2018 as illegal and contrary to law and consequently direct the 1st respondent to restore possession of the said tenanted house property at New No.10, Old No.5, Saradambal Street, Gokulam Colony, T.Nagar, Chennai-600 017 to the petitioner.

ORDER

The learned counsel for the petitioner seeks leave of this Court to withdraw the writ petition with liberty to approach the Debts Recovery Tribunal in relation to the order passed in the application filed under Section 14 of the SARFAESI Act. She has also made an endorsement to the said effect.

2. In view of the above, the writ petition is dismissed as withdrawn with liberty as prayed for. No costs. Consequently, W.M.P.No.22679 of 2019 is closed.
