This application has been filed seeking to condone the delay of 98 days in filing the reply statement by the plaintiff to the written statement /counter claim filed by the defendants.

2. In the affidavit filed in support of the application, it had been stated that the plaintiff had to search for supporting documents, which were nearly 50 years old and only after they could be located, instructions could be given to prepare a reply statement.

3. Taking into consideration that reply statement is required, since the defendants have filed written statement/counter claim, the delay is condoned. The application stands allowed.
